NAHVAC recognizes the importance of privacy and the sensitivity of personal information. As a company we have a legal obligation to keep confidential all information we receive from our customers. We are committed to protecting any personal information we hold. This Privacy Policy outlines how we manage and safeguard your personal information.

Your privacy rights

From January 1, 2004, all businesses engaged in commercial activities across Canada, including NAHVAC, must comply with federal and provincial privacy legislation. This legislation gives you privacy rights concerning the personal information that you provide when conducting business. NAHVAC is responsible for the personal information we collect and hold. To ensure this accountability, we have developed this policy and trained our corporate officers and support staff about our policies and practices.

Why does NAHVAC need personal information?

We collect, use and disclose personal information in order to provide you with our products and services, to manage our customer accounts, and to produce direct marketing materials to inform you of services and new products that we may have to offer.

What personal information do we collect?

Personal information is any information that identifies you, or by which your identity could be deduced. We only collect information that is reasonably necessary to provide you with our products and services.

How do we collect your personal information?

We collect information only by lawful and fair means and not in an unreasonably intrusive way. Wherever possible we collect your personal information directly from you in the course of our business relationship. Sometimes we may obtain information about you from other sources: for example, your insurance company, your bank or credit card company, from a government agency or registry, from your accountant.

In most cases, we will ask you to consent to the collection, use, or disclosure of your personal information. Normally, we ask for your consent in writing, but in some circumstances, we may accept your oral consent. Sometimes, your consent may be implied through your business relationship with us.

Disclosure of your personal information

NAHVAC may be required to disclose your personal information without your consent when we are authorized by law to do so. For example, if a Court order is issued ordering the disclosure of your personal information, we will be required by law to comply with the Order.

NAHVAC may also disclose personal information when your consent to the disclosure of that information is implied as follows:

  • Where disclosure is necessary for us to collect payment from you;
  • Where we engage a third party to provide administrative services to us (for example, computer back-up services or archival file storage) and the third party is bound by our Privacy Policy;
  • Where we engage a subcontractor to provide products or services to you and the subcontractor is bound by our Privacy Policy;
  • Where the information about you is already publicly known.

NAHVAC does not disclose your personal information to any third party to enable them to market their products and services. For example, we do not provide our client mailing lists to other companies.

Since we use your personal information to provide products and services to you, it is important that the information be accurate and up-to-date. If during the course of providing these products and services any of your information changes, please inform us so that we can ensure the accuracy of our records.

Is my personal information secure?

NAHVAC takes all reasonable precautions to ensure that your personal information is kept safe from loss, unauthorized access, modification or disclosure. You may request access to any personal information we hold about you. A summary of your personal information will be available to you on request. Should you require more detailed information involving archival searches or other retrieval costs, your request may be subject to photocopying and other fees.

Amending your personal information

If NAHVAC holds information about you and you can establish that it is not accurate, complete and up-to-date, we will take reasonable steps to amend our records.

Can I be denied access to my personal information?

Your rights to access your personal information are not absolute. We may deny access if denial of access is required or authorized by law. For example we may deny access:

  • If granting access would have an unreasonable impact on other people’s privacy;
  • If granting access would be an unreasonable invasion of our company’s rights;
  • If there is no merit to the request, or it is intended to harass others.

In some cases it may be necessary to deny access to an entire document. In other cases it may be necessary to withhold certain portions of a document to protect the privacy rights of someone else. If we deny your request for access, or refuse your request to correct information, we will explain why.
